域名 – “网络商标”
前阵子,谷歌阿根廷的域名(www.google.com.ar)被一名叫 Nicolas Kurona 的网页设计师买下并“短暂”地成为其域名持有者。 这名网页设计师无意间发现无法在浏览器中成功登入www.google.com.ar,便上了阿根廷网络信息中心 (Network Information Center Argentina, NIC) 查询。查询之下他发现谷歌阿根廷的域名可以被购买,于是他通过正常注册程序以 270 阿根廷比索 (约RM 12)购下了该域名。 然而,NIC很快便开始停机维护并接管了这个域名,再将其归还给了谷歌。虽然谷歌很快收回了域名,但用户仍然经历了大约三个小时的网络故障。虽然NIC和谷歌没有透露发生了什么事,该域名为何会被出售,但估计可能是网络故障或是谷歌忘记续费更新域名才会出现这种状况。而谷歌会不会对抢注其域名的 Nicolas Kurona采取法律行动也就不得而知。 什么是域名? 域名(英语:Domain Name),又称网域,是由一串用点分隔的名字组成的网络上某一台计算机或计算机组的名称,用于在数据传输时对计算机的定位标识。由于IP地址 (Internet Protocol Address) 不方便记忆并且不能显示地址组织的名称和性质,域名可以说是一个让IP地址更容易让人们记住和使用的代称,通过网域名称系统(Domain Name System)来和IP地址相互映射,使人们更方便地访问互联网。 域名是知识产权吗?对企业又有什么帮助? 域名是企业无形资产的一部分,并渐渐成为十分有价值的知识产权。实际上域名存在的意义与商标等同,也可以说是 “网络商标”。 和商标相似,注册域名也需要申请和更新。大部分机构或企业都采用自己单位名称、商标、产品名称的全拼或缩写来定义自己的域名,以方便他人记忆和识别。由于每一个域名都是独一无二的,而且申请会遵循“先到先得”原则,倘若某个域名已经被注册,那么其他任何机构则不能再注册相同的域名。 随着互联网发展日新月异,网络消费日益渐涨,域名已成为网络消费者收集购物信息和做出购买抉择的重要渠道。通过注册域名和设立网址,企业对外界建立了访问通道,网络用户可以随时随地链接查看,从而获得广泛的商业咨询与联系,继而造就商机和提高消费者的关注。 在决定注册域名之前,企业应当关注目前的域名发展趋势,对潜在的网络侵权、风险和名誉损害进行前期调查,分析营运成本和其他方面的考量,并制定相应的域名策略。适当的调查可以帮助企业分析其目前的商标、企业名称、产品名称和专利等的相关域名状况和未来的市场,从而提升品牌认知和价值,更提防域名侵权、恶意抢注、网络售假、恶意仿冒等问题。 域名的商业价值不容忽视,而且已成为代表一个企业形象的标志。因次,域名保护刻不容缓。企业应该考虑及时进行域名注册以防患于未然,即保护自身商业形象,也防止他人侵权行为。 ** 免责声明: 以上资讯只供分享及参考并非正式法律意见。读者可依据自身情况再咨询作者或其他专业人士。 © 2024 Venture Intellectual Property Sdn Bhd.
