什么是商标在先使用?在先申请?为什么对你的企业这么重要
让我们现在看这个‘在先’原则会对你的商标品牌有多大的影响? 我们平时排队买东西,先到先得的概念非常简单。 但是在商标的世界里,就不像排队买东西这么简单了! 世界各国在与商标 ‘在先’ 的原则上分为两个阵营。虽然每个国家都奉行‘在先’原则,但需看那个国家是以 ‘使用在先’ 还是 ‘申请在先’作为准则, 因两者有着巨大的差别。 首先,商标权具有属地性,其保护范围仅限于申请注册的国家,因此每个国家都有自己独立的商标注册制度和商标法律。但是必须注意的是每个国家都会以‘在先’原则作为其中一个重要的审核要素。意思是在某商标申请之前是否已有 ‘在先’的相同或是近似的商标存在。 ‘使用在先’ 原则是以有关商标在某国家使用的时间为考虑。,即使这个商标没有注册,只要有持续使用,于注册时他仍属于 ‘在先’ 的商标考虑。当审查员考虑一个商标的申请时,未必能巨细无遗了解所有未为注册前的使用情况, 因此在出现商标注册后出现反对的情况较多。, 届时双方需要提供使用证据供,法庭会根据证据的可信度和两者的相似度等方面进行抉择,已注册的商标有机会被推翻。目前,马来西亚,新加坡和多数欧美国家就奉行 ‘使用在先’原则。 反之, ‘申请在先’ 原则是以有关商标在某国家提交申请的时间作为标准, 简单来说,先到先得,不考虑有没有前者在市场使用但未有注册的商标。此原则的审查在时间方面比较简单,只针对其官方的资料库有没有在先申请者。但是 在‘申请在先’原则下容易出现恶意抢先注册的问题,令真正的商标创立者蒙受损失。目前很多国家还是奉行‘申请在先’ 原则,这包括中国。 所以,如果有意将品牌在将来拓展到‘申请在先’的国家(例如中国),建议大家及早注册,以免被抢注,无法取回当地的商标 ** 免责声明: 以上资讯只供分享及参考并非正式法律意见。读者可依据自身情况再咨询作者或其他专业人士。 © 2024 Venture Intellectual Property Sdn Bhd.
